Introduction

Arbor Boutique Hotel (“we”, “our” or “us”) welcomes you to our website. These Terms and Conditions set out the basis on which we provide accommodation, dining and related hospitality services. Our property is located in Brufut, The Gambia. The business is registered in both the United Kingdom and The Gambia but operates solely in The Gambia. By making a reservation or using this website you agree to abide by these terms. They explain how to book, pay, modify or cancel a reservation, what is expected from guests and what you can expect from us. We apply English law because of our UK registration, and nothing in these terms affects your statutory rights under local law in The Gambia.

Definitions

  • Accommodation – rooms, suites or apartments and associated services we offer.
  • Reservation – a request from you for accommodation or services that we confirm in writing (usually by email). A “group booking” refers to a reservation for multiple rooms.
  • Services – accommodation, meals, excursions and other hospitality services described on our website or marketing materials.
  • Lead guest – the person named on the booking confirmation who is responsible for all guests included in the reservation.

Making a reservation

  1. Reservations can be made via our website, by email or over the phone. When submitting a request, please provide accurate information including the names of all guests, dates of stay, contact details and any special requirements. Your reservation is confirmed only when you receive a written confirmation from us.
  2. You must be at least 18 years old to make a booking. Group bookings or long-stay reservations may require a signed agreement or additional deposit.
  3. Unless otherwise stated, a non-refundable deposit equal to 20 % of the total accommodation cost is required to secure your booking. The remaining balance is due six weeks before arrival. If you book within six weeks of your arrival date, the full amount is payable at the time of booking. Payments may be made to our UK bank account or any other method specified at the time of booking.
  4. Special offers and promotional rates may carry additional conditions, such as pre-payment in full or restrictions on changes and refunds. These conditions will be communicated when you book.

Fees and payment

  1. Room rates are quoted per night and include all taxes unless stated otherwise. Prices depend on room type, number of guests and the dates of stay. Discounts may be available for longer stays or during low-season periods.
  2. We accept major credit and debit cards. You may be asked to provide a valid card to guarantee your reservation. Any additional charges incurred during your stay, such as meals, excursions, extra bedding or late-checkout fees, must be settled in full before departure.
  3. An additional nightly charge may apply for extra guests sharing a room. Charges vary depending on age and occupancy and will be explained when you book.

Cancellations and no-shows

  1. Standard reservations can usually be cancelled or modified free of charge if notice is given at least 24 or 48 hours before the scheduled arrival; the exact notice period will be stated in your confirmation. If you cancel after the deadline or fail to arrive, we reserve the right to retain your deposit or charge for one night’s stay.
  2. Deposits are non-refundable and non-transferable. For promotional or pre-paid rates, cancellation terms may be more restrictive and the entire stay may be charged; you will be informed of these conditions at the time of booking.
  3. Occasionally circumstances beyond our control (such as natural disasters, government action or essential maintenance) may require us to cancel your booking. If this happens we will notify you and refund any payments you have made. We are not responsible for any other losses or expenses you may incur.

Check-in and check-out

  1. Unless otherwise specified, check-in time is from 3 pm and check-out is by 11 am. Early check-in or late check-out can sometimes be arranged subject to availability. Late check-out may incur an additional fee.
  2. Please bring valid identification (passport or national ID card) when you check in. The lead guest must be present for the duration of the stay.
  3. We reserve the right to charge a full extra night if you fail to vacate your room by the agreed check-out time.

Guest responsibilities and hotel rules

  1. Guests are expected to behave respectfully and not disturb other guests or damage the hotel’s property. We may ask you to leave (without refund) if your behaviour endangers staff or other guests or causes damage.
  2. All rooms and interior spaces are non-smoking. A cleaning fee will be charged if you smoke in prohibited areas. Designated outdoor areas may be available for smoking.
  3. You are liable for any damage to our property or missing items caused by you or anyone in your party. We may charge the cost of repair or replacement to the payment method used for the booking.
  4. For safety reasons, unregistered visitors are not permitted in guest rooms without prior approval. Children under 18 years old must be supervised by an adult at all times.
  5. Pets are welcome only if specifically agreed at the time of booking. Pets must be supervised and kept on a leash in public areas, and you are responsible for any mess or damage.

Food and drink

  1. We take reasonable care to provide a safe environment, but your stay is at your own risk. We are not responsible for loss, theft or damage to your personal property unless caused by our negligence. We recommend using the in-room safe (if available) and obtaining suitable travel insurance.
  2. Our liability for any loss or damage arising from your booking or stay is limited to the total amount paid for your reservation, except where the law prohibits such limitation (for example, in cases of death or personal injury caused by our negligence).

Force majeure

We are not liable for any failure or delay in performing our obligations under these terms if that failure or delay is caused by events beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, government regulations, pandemics, strikes or failures of public utilities.

Data protection

We collect and process personal information in order to manage reservations, provide services, process payments, communicate with you and meet our legal obligations. We do not sell your data and will only share it with service providers who need it to perform tasks on our behalf (such as payment processing). Governing law and jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with the law of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, although we retain the right to pursue proceedings for unpaid sums in any relevant jurisdiction. Local consumer protection laws of The Gambia may also apply in certain circumstances.

Changes to these terms

We may amend these Terms and Conditions from time to time. The most recent version will always be available on our website. Changes will not affect existing reservations unless the new terms are more favourable to you.
